Judge orders four Falls cops promoted to detective
NIAGARA FALLS - A judge has ruled that four Niagara Falls police officers have been doing the work of detectives for years and should be titled - and paid - accordingly.
State Supreme Court Justice Ralph A. Boniello III signed an order Friday that the city must give crime-scene officers Jason G. Sykes, Marc C. Martinez, Todd N. Faddoul and Shawn S. Arndt the title of detective, and retroactively pay them for a detective's duties since they became crime-scene officers.
Edward P. Perlman, who represented the officers, said Monday that the back pay "is probably $3,000 to $3,500 per year, per man."
Deputy Corporation Counsel Christopher M. Mazur said Monday that the city will appeal Boniello's ruling.
Basing their claim on state civil service law, the officers asserted that they were entitled to be promoted to detective after 18 months of doing equivalent work on "temporary assignment" in the crime-scene unit. Martinez joined the crime-scene unit in June 2001, Sykes in July 2007, Arndt in September 2007 and Faddoul in September 2008.
Mazur argued that, in "the opinion of everybody in the department hierarchy," crime officers' duties are "separate and distinct from what detectives do."
Boniello didn't buy it. He noted that Capt. William M. Thomson, chief of detectives, "acknowledged on the [witness] stand that the job descriptions for prospective applicants to become [crime scene officers] are vague. Significantly, there is no clear distinction between the day-in and day-out work [of detectives and crime-scene officers]."
The only difference Boniello could find between the two job titles was that detectives perform interrogations and make arrests. That wasn't enough of a difference to lead him to throw out of the four officers' suit, which was filed in March of this year.
Perlman said he wasn't surprised the city will appeal, since "the city has refused to meet with us any step along the way." He added that he offered to have his clients forgo the back pay if the Police Department would give them the title of detective.
"The city wouldn't even respond. It's par for the course," Perlman said.

The union has got some big sized challenges on their plate this week. The Derenda administration is going ahead with "transfers" tonight. Many people being moved through out the city. Even more transfers "in house". I heard one platoon in Delta lost 8 officers. It apparently was a revolt against an unpopular female lt. (Standcke). In other districts, spots were taken up by returning Strike force members and former MRU officers. C & E seem to be affected the most with them. Accompanying all this movement is a union grievance against the city. This grievance is something the union won long ago. It was agreed upon that transfers only take place in January. There are many reasons why this rule was set, a rule that gave some leeway when promotions and retirements accrued. For the city to just disregard this rule against union objection, is another blatant demonstration of the cities disregard for the PBA and its members. This doesn't mean, that some PBA members are not happy that the city went ahead with the transfers. If you are one of the officers who wanted a transfer, then i'm sure you don't mind not waiting until January. But it still goes against an agreed upon contract that the city continually disregards to suit their likings.

State police Troop T Sgt. Thomas Ferritto said troopers play a prominent role in reducing highway fatality rates in New York and issue more than 900,000 tickets each year.

I am a Union delegate. I don’t usually respond to the crap posted on Leftyline, however I believe the record must be made clear regarding the above statement. First the PBA has never agreed with anyone let alone the City, as to anyone in the membership sidestepping the collective bargaining agreement (Contract) with regards to overtime. We have fought for over 25 years to make seniority the benchmark that the Administration MUST follow. Shall we return to the days of assigning special assignments, Squads, Units to the good old days of handing checks to the Mayors office? The term “Specialty Units” in the contract refers to the URT,SWAT, and HMT. The only provisions with regards to usurping “seniority rights” are with regards to the Commanders position” We allowed the City of Buffalo ( Commissioner) to pick whom they felt comfortable with. The applicants to the SWAT unit are strictly picked in “order of seniority” after passing a series of tests, period. As to the referenced blog comment please note that currently this grievance has advanced to Step-3. Had our Attorney Jim Schwan or our President thought for a moment this grievance was not valid it would have been stopped at the 2nd level.

No Matter what you think the facts are we are behind other departments around 18,000 to 20,000 dollars.We still answer over 300,000 call a year.The city has the money to pay.They can't be that dumb .People would say if they where leaving early where was downtown.The slide went away a long down ago.In the end they are going have to pay like all the other departments around us..

Jamestown Police say when a Barker Street resident returned home and found two intruders there, a struggle ensued.
Authorities say the resident fought the two suspects Wednesday afternoon around 11:30 a.m., stabbing one, who later died just a short distance from the resident's home. The second suspect escaped and fled to WCA Hospital and is currently being treated for a stab wound.
Police have not released the name of the resident, the name of the man killed by the resident, or the name and condition of the second suspect.

Seniority works for ot and transfers but plain ol common sense says it shouldnt be allowed for specialty units. Getting thru a physical fitness test doesnt prove you will be a good fit for any specialty position. They are called special units because the men in those positions are supposed to be excellent at what they do. It benefits everybody to do it that way. The reputation of the team and the people they are sent out to save all get fucked if its not. The state officer has a point, giving awards for good police work and heroism does get confused with acts of desperation that some officers are faced with. I heard most of the Narcs got at least 70 hrs of OT in the last check and that didn't include day 3of the sweep which is in the next pay period. The reason the raids weren't effective is because the sweep was publicized on day one with the comment "the raids will continue throughout the weekend"! In the September meeting a by law change was proposed and our president acknowledged that he knew about it and agreed with it but then at the October meeting when it came back up he said he didn't know anything about it. Detroit — Before the Tigers took on the Oakland Athletics at Comerica Park Saturday, members of the Detroit Police Officer's Association passed out fliers to "let the public know they enter Detroit at their own risk."
About 300 officers in plain clothes handed out pamphlets and fliers urging people to vote against the emergency manager law ballot proposal and for the collective bargaining ballot proposal as fans headed in to Game 1 of the American League Division Series.
"The city is getting more dangerous," said DPOA President Joe Duncan. "In fact, the only thing I know that's going down in the city of Detroit is my paycheck and my membership."
Originally the union had planned a rally, but shifted focus on passing out the campaign literature for Proposals 1 and 2 in a half-mile radius around Grand Circus Park.
The DPOA and the city of Detroit are currently at odds over a new contract that calls for 10 percent pay cuts and 12-hour shifts for police officers.
The current contract for the union's 2,130 members expired June 30. In an attempt to save $350 million during the fiscal year that started July 1, the city also called for changes to its heath care plan with increased out-of-pocket costs and changes to pension and work rules.
Representatives for the City of Detroit couldn't be reached Saturday.
In July, an Ingham County judge ruled the city isn't required to bargain with the officers over pay and benefits. The union contends the city is required to enter arbitration under Public Act 312. It's illegal for public safety officers in the state to strike. The law is designed to force negotiations.
Duncan has said the move by the city is tantamount to union busting and further cuts to police would be disastrous.
"What you are seeing now is when businesses put profit before the welfare of the people," said Duncan. "What the city is doing is putting the safety of the residents and people visiting this city in jeopardy."

Judge orders four Falls cops promoted to detective
NIAGARA FALLS - A judge has ruled that four Niagara Falls police officers have been doing the work of detectives for years and should be titled - and paid - accordingly.
State Supreme Court Justice Ralph A. Boniello III signed an order Friday that the city must give crime-scene officers Jason G. Sykes, Marc C. Martinez, Todd N. Faddoul and Shawn S. Arndt the title of detective, and retroactively pay them for a detective's duties since they became crime-scene officers.
Edward P. Perlman, who represented the officers, said Monday that the back pay "is probably $3,000 to $3,500 per year, per man."
Deputy Corporation Counsel Christopher M. Mazur said Monday that the city will appeal Boniello's ruling.
Basing their claim on state civil service law, the officers asserted that they were entitled to be promoted to detective after 18 months of doing equivalent work on "temporary assignment" in the crime-scene unit. Martinez joined the crime-scene unit in June 2001, Sykes in July 2007, Arndt in September 2007 and Faddoul in September 2008.
Mazur argued that, in "the opinion of everybody in the department hierarchy," crime officers' duties are "separate and distinct from what detectives do."
Boniello didn't buy it. He noted that Capt. William M. Thomson, chief of detectives, "acknowledged on the [witness] stand that the job descriptions for prospective applicants to become [crime scene officers] are vague. Significantly, there is no clear distinction between the day-in and day-out work [of detectives and crime-scene officers]."
The only difference Boniello could find between the two job titles was that detectives perform interrogations and make arrests. That wasn't enough of a difference to lead him to throw out of the four officers' suit, which was filed in March of this year.
Perlman said he wasn't surprised the city will appeal, since "the city has refused to meet with us any step along the way." He added that he offered to have his clients forgo the back pay if the Police Department would give them the title of detective.
"The city wouldn't even respond. It's par for the course," Perlman said.

The union has got some big sized challenges on their plate this week. The Derenda administration is going ahead with "transfers" tonight. Many people being moved through out the city. Even more transfers "in house". I heard one platoon in Delta lost 8 officers. It apparently was a revolt against an unpopular female lt. (Standcke). In other districts, spots were taken up by returning Strike force members and former MRU officers. C & E seem to be affected the most with them. Accompanying all this movement is a union grievance against the city. This grievance is something the union won long ago. It was agreed upon that transfers only take place in January. There are many reasons why this rule was set, a rule that gave some leeway when promotions and retirements accrued. For the city to just disregard this rule against union objection, is another blatant demonstration of the cities disregard for the PBA and its members. This doesn't mean, that some PBA members are not happy that the city went ahead with the transfers. If you are one of the officers who wanted a transfer, then i'm sure you don't mind not waiting until January. But it still goes against an agreed upon contract that the city continually disregards to suit their likings.

In the old days the first officer(s) who responded would do the MV104 and if it was serious injury or a fatal, would call for AIU to respond. The AIU officer would show up, take statements, take photos, take measurements and collect evidence. Now, mostly Lt Slumber in the Lumber and his vertically challenged toadie, show up on OT, stand around playing pocket billards(sometimes with each other)and call for photo and evidence. WTF are they doing to merit so much OT????????? If anyone out there can explain this please respond.

Hey, did the department ever discipline those scumbag officers from C district for letting a fellow officer get seriously hurt? I still see the scumbag lt and some of those scumbag officers who were skipping out early that day and refusing to back up their fellow officer. The result was a serious injury to that officer. When is the department going to discipline these scumbags?
People operate with grudges in this business. I'm not surprised someone was hurt because people either left early or refused to go. This is not the first time this has happened in the history of law enforcement...
Enough time has elapsed, the guilty parties must pay for their indiscretions on that fateful day in C district. The SWAT commander IS following the contract and arbitration rulings that state unequivocally that SWAT, HMT, and URT are specialty units comprised of voluntary members and therefore are NOT subject to seniority rules. The City and Union agree. Basically, the respective commanders make the call-ins based on what job has to be done and what personnel are best suited to do that job. Look at the complainers and do a quick credibility check. You'll find the real culprit is greed.

Since Lib & My Ball Lick retired, the C slide has slowed some.... It is still hard to get backup after 8 or 9 pm when those lucky afternoon guys get the slide. Rumor has it, that Delta is sliding more than ever. IAD has pictures of officers leaving early. Some are seen running out of the building shielding their faces as they look up at the camera. When the city sits down for arbitration, they will use these pictures and proof to deny the hardworking, loyal officers a raise. City hall fights dirty, and we are sitting ducks for their debauchery. Lt. Fartman was heard talking about Delta officers leaving early. He said "you could see his balding crown in the light as he ran to his car, all while his sparsely blowing hair strands blew in the wind. I thought I was watching Ichabod Crane running from the sleepy hollow!" As funny as these photos must be, they will be the damming proof to deny our PBA any gains for its members.

I am a Union delegate. I don’t usually respond to the crap posted on Leftyline, however I believe the record must be made clear regarding the above statement. First the PBA has never agreed with anyone let alone the City, as to anyone in the membership sidestepping the collective bargaining agreement (Contract) with regards to overtime. We have fought for over 25 years to make seniority the benchmark that the Administration MUST follow. Shall we return to the days of assigning special assignments, Squads, Units to the good old days of handing checks to the Mayors office? The term “Specialty Units” in the contract refers to the URT,SWAT, and HMT. The only provisions with regards to usurping “seniority rights” are with regards to the Commanders position” We allowed the City of Buffalo ( Commissioner) to pick whom they felt comfortable with. The applicants to the SWAT unit are strictly picked in “order of seniority” after passing a series of tests, period. As to the referenced blog comment please note that currently this grievance has advanced to Step-3. Had our Attorney Jim Schwan or our President thought for a moment this grievance was not valid it would have been stopped at the 2nd level.

Jamestown Police say when a Barker Street resident returned home and found two intruders there, a struggle ensued.
Authorities say the resident fought the two suspects Wednesday afternoon around 11:30 a.m., stabbing one, who later died just a short distance from the resident's home. The second suspect escaped and fled to WCA Hospital and is currently being treated for a stab wound.
Police have not released the name of the resident, the name of the man killed by the resident, or the name and condition of the second suspect.

Some act's are just criminal. The difference is in the law, and in who saw you commit the act. An act may be sufficiently sound when applied to the law, until an eye witness or two dispute the actors account. This is where the District Attorney must distinguish between fact and fiction. They and their investigators must weigh the facts to consider whether to prosecute or not. It all boils down to the facts and if they match the actors reasons for committing an act. The bottom line, did the actor lie? A very complex process, but one that keeps our police officers somewhat honest. One bad apple spoils the reputation of everyone. That is why it is so important for the District Attorneys officer to do their job well.
The state officer has a point, giving awards for good police work and heroism does get confused with acts of desperation that some officers are faced with. I think they generously give these awards to officers that get in sticky situations just to help the healing process. Its to make that officer feel better and to help the healing process. Its just a gesture, an award means nothing at the end of the day. Dont be so judgemental, it could happen to you someday, hopefully your fellow officers will carry you.

I heard most of the Narcs got at least 70 hrs of OT in the last check and that didn't include day 3of the sweep which is in the next pay period. The reason the raids weren't effective is because the sweep was publicized on day one with the comment "the raids will continue throughout the weekend"!

This is regarding the last 2 union meeting while I am not a delagate I was at both. In the September meeting a by law change was proposed and our president acknowledged that he knew about it and agreed with it but then at the October meeting when it came back up he said he didn't know anything about it. I can't believe this guy would outright lie to everyone at the meeting. While I was unsure on the proposal in September I am all for it now cause I can see how out president is a two faced liar and coward.

Detroit — Before the Tigers took on the Oakland Athletics at Comerica Park Saturday, members of the Detroit Police Officer's Association passed out fliers to "let the public know they enter Detroit at their own risk."
About 300 officers in plain clothes handed out pamphlets and fliers urging people to vote against the emergency manager law ballot proposal and for the collective bargaining ballot proposal as fans headed in to Game 1 of the American League Division Series.
"The city is getting more dangerous," said DPOA President Joe Duncan. "In fact, the only thing I know that's going down in the city of Detroit is my paycheck and my membership."
Originally the union had planned a rally, but shifted focus on passing out the campaign literature for Proposals 1 and 2 in a half-mile radius around Grand Circus Park.
The DPOA and the city of Detroit are currently at odds over a new contract that calls for 10 percent pay cuts and 12-hour shifts for police officers.
The current contract for the union's 2,130 members expired June 30. In an attempt to save $350 million during the fiscal year that started July 1, the city also called for changes to its heath care plan with increased out-of-pocket costs and changes to pension and work rules.
Representatives for the City of Detroit couldn't be reached Saturday.
In July, an Ingham County judge ruled the city isn't required to bargain with the officers over pay and benefits. The union contends the city is required to enter arbitration under Public Act 312. It's illegal for public safety officers in the state to strike. The law is designed to force negotiations.
Duncan has said the move by the city is tantamount to union busting and further cuts to police would be disastrous.
"What you are seeing now is when businesses put profit before the welfare of the people," said Duncan. "What the city is doing is putting the safety of the residents and people visiting this city in jeopardy."
